These Terms of Use ("Terms") govern your access to and use of the website at hexadu.com (the "Site"), operated by Elowin Labs LLC, a Florida limited liability company ("we", "our"). By visiting or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
The short version: This Site is the marketing home for the Hexadu mobile app. You're welcome to browse, share links, and read about the game. These Terms cover the website only — the Hexadu app itself is governed by Apple's standard end-user license agreement and our Privacy Policy, not this document.
1. The Site versus the App
This document governs only the website at hexadu.com. The Hexadu app, distributed through the Apple App Store, is governed by:
- Apple's Licensed Application End User License Agreement (the "Standard EULA"), which applies automatically when you download the app from the App Store. The Standard EULA is available at apple.com/legal/internet-services/itunes/dev/stdeula.
- Our Privacy Policy, available at hexadu.com/privacy, which describes what data the app collects and how it is handled.
Nothing in this document modifies, replaces, or limits those agreements.
2. Permitted use of the Site
You may use the Site for personal, non-commercial purposes — read it, view it, link to it, share links from it. You may not:
- Use automated systems (bots, scrapers, spiders, crawlers) to access the Site at a rate, volume, or pattern beyond what a normal web browser would generate;
- Attempt to interfere with, disable, probe, or circumvent the security or operation of the Site;
- Resell, redistribute, or commercially exploit content from the Site;
- Use the Site to send unsolicited messages, distribute malware, or engage in any unlawful activity;
- Misrepresent your identity or impersonate Elowin Labs in any communication relating to the Site.
3. Intellectual property
The Site and its content — including text, graphics, logos, screenshots, the "Hexadu" name and logo, and the "Elowin Labs" name and logo — are owned by Elowin Labs or its licensors and are protected by copyright, trademark, and other applicable laws. You receive no license to any of this content except the limited permission to view the Site as it is intended to be viewed.
Names of products and companies mentioned on the Site that are not ours (for example, "Apple", "App Store", "iOS") are trademarks of their respective owners and are referenced only for descriptive purposes.
4. Disclaimers
The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or accurate, or that any defects will be corrected.
The Site may include links to third-party websites or resources. We do not control and are not responsible for the content, accuracy, policies, or practices of those sites; visiting them is at your own risk.
5. Limitation of liability
To the maximum extent permitted by law, Elowin Labs is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — or for lost profits, lost data, or business interruption — arising out of or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or related to the Site, regardless of legal theory, shall not exceed one hundred US dollars ($100.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above may not apply to you.
6. Indemnification
You agree to indemnify and hold Elowin Labs harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your misuse of the Site, or (b) your violation of these Terms.
7. Changes to these Terms
We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after a change takes effect constitutes your acceptance of the revised Terms. If you do not agree with a revision, please stop using the Site.
8. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.
9. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary; the remaining provisions remain in full force.
